Terms of Service

By accessing the Site, completing any form on the Site, or otherwise interacting with the Site, you represent that (a) you are at least 18 years of age or accessing the Site under the supervision of a parent or legal guardian; (b) you have the legal capacity to enter into these Terms; and (c) you agree to comply with these Terms and all applicable laws and regulations.

The content on the Site is provided for general informational and educational purposes only. It is NOT medical advice, diagnosis, or treatment, and it is NOT a substitute for the professional judgment of a qualified healthcare provider.

Use of the Site does not create a doctor-patient relationship between you and Healing TMS Clinic, its psychiatrists, or any other clinician affiliated with the practice. A doctor-patient relationship is established only after you have completed our clinical intake process, attended a consultation with a licensed clinician, and been formally accepted as a patient.

Do not delay seeking, or disregard, professional medical advice based on anything you read on the Site. If you are experiencing a medical or psychiatric emergency, including thoughts of harming yourself or others, call 911 or go to the nearest emergency department immediately. In the United States, you may also call or text 988 to reach the Suicide and Crisis Lifeline.

Information on the Site about transcranial magnetic stimulation, medication management, depression, anxiety, and related conditions describes the practice's services and general clinical concepts. It does not establish that any specific treatment is appropriate for any specific reader. Treatment recommendations require a clinical evaluation.

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site;
• Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission, except for search-engine indexing and accessibility tooling consistent with our published robots.txt;
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Site, the server on which the Site is hosted, or any server, computer, or database connected to the Site;
• Attack the Site via a denial-of-service attack, distributed denial-of-service attack, or any similar activity;
• Submit false, misleading, or fraudulent information through any form on the Site;
• Submit Protected Health Information of any individual other than yourself, or submit PHI through a form that is not designated for clinical intake;
• Use the Site to transmit any malware, virus, worm, Trojan horse, or other code of a destructive nature;
• Use the Site to harvest or collect email addresses or other contact information of other users by electronic or other means.

The Site and its entire contents, features, and functionality — including but not limited to text, graphics, logos, images, video, audio, software, design, structure, and the selection and arrangement of the foregoing — are owned by Healing TMS Clinic, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual-property laws.

You may view and print pages from the Site for your personal, non-commercial reference. You may not otherwise reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Site without our prior written consent. Use of any Healing TMS Clinic name, logo, or service mark without our prior written permission is prohibited.

Third-party trademarks referenced on the Site — including but not limited to Brain Ultimate (Brain Ultimate Co.), Sabers Medical Blossom, BrainsWay, and the names of insurance carriers — are the property of their respective owners and are used for identification purposes only.

If you submit information to us through a Site form — including but not limited to consultation requests, insurance verification inquiries, and general contact messages — you represent that the information is accurate and that you have the right to provide it. We will treat your submission in accordance with our Privacy Policy and, where applicable, our HIPAA Notice of Privacy Practices.

We do not guarantee that any submission will receive a response within a particular timeframe. We reserve the right to refuse to respond to submissions that violate these Terms or that we, in our sole discretion, determine to be inappropriate.

THE SITE AND ALL CONTENT, MATERIALS, INFORMATION, AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEALING TMS CLINIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected. We do not warrant the accuracy, completeness, or timeliness of any clinical, scientific, regulatory, or insurance-related information on the Site. Coverage criteria, FDA clearances, clinical guidelines, and statistical data change over time; readers should verify current information with primary sources or with a qualified clinician.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL HEALING TMS CLINIC, ITS AFFILIATES, OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the foregoing limitations apply to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Healing TMS Clinic and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your misuse of the Site.

These Terms and any dispute arising out of or relating to these Terms or the Site are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any action at law or in equity arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.

We may revise these Terms from time to time. The most current version will always be posted on the Site with an updated "Effective Date." Material changes will be communicated through an updated "Last Updated" date and, where appropriate, through more prominent notice on the Site. Your continued use of the Site after a revision constitutes your acceptance of the revised Terms.

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
